Tax Liens or Levies

What is a tax lien?

A federal tax lien is the government’s legal claim against your property when you neglect or fail to pay a tax debt. The lien protects the government’s interest in all your property, including real estate, personal property and financial assets. A federal tax lien exists after:

The IRS:

  • Puts your balance due on the books (assesses your liability);
  • Sends you a bill that explains how much you owe (Notice and Demand for Payment); and

You:

  • Neglect or refuse to fully pay the debt in time.

The IRS files a public document, the Notice of Federal Tax Lien, to alert creditors that the government has a legal right to your property.

What is a tax levy?

An IRS levy permits the legal seizure of your property to satisfy a tax debt. It can garnish wages, take money in your bank or other financial account, seize and sell your vehicle(s), real estate and other personal property. In short, you could lose everything if you owe the IRS enough money and they seize your property to satisfy this debt.

If you receive an IRS bill titled Final Notice of Intent to Levy and Notice of Your Right to A Hearing, contact me right away.

What should you do?

As in all matters related to the IRS -- time is of the essence. Once you receive notification, a clock starts ticking. Typically, you have 90 days to respond -- but depending on any prior notifications that have gone unanswered, this period of time may be reduced (or not exist). Depending on your financial situation, and the amount of money owed, there may be mitigating opportunities that I can help put into place, for you.
